Terms of Service

These Terms of Service ("Terms") govern your use of LocalPulseHub ("the Service"). By creating an account or using the Service, you agree to these Terms.

1. Service description

LocalPulseHub connects to your Google Business Profile, fetches your customer reviews, and uses AI to draft on-brand replies in English, German, French, and Spanish. Replies are either reviewed and approved by a human before publishing (manual approval) or published automatically after a delay when auto-pilot is enabled. You control which mode applies to your account.

2. Account requirements

• You must provide accurate registration information and keep it up to date.
• You must verify your email address and complete phone verification before the Service becomes fully available.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be authorized to manage the Google Business Profiles you connect to the Service.

3. Free trial

New accounts may start with a 14-day free trial, with no payment card required. At the end of the trial, access to the Service is restricted until you subscribe to a paid plan. We may send reminder emails as your trial approaches its end.

4. Billing

• Paid subscriptions are billed through Paddle, which acts as our merchant of record. Your payment is a transaction with Paddle, and Paddle's buyer terms apply to the purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You can cancel at any time from the billing page. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Prices are shown on the pricing page and may change with reasonable notice for future billing periods.

5. Cancellation and refunds

• Cancellation: You can cancel your subscription at any time from the billing page. Cancellation takes effect at the end of the current billing period; you retain full access until then. No partial-period charges apply after cancellation.
• Free trial: If you start a free trial and cancel before it ends, you are not charged.
• Refunds:Because Paddle is our merchant of record, refund requests are handled under Paddle's buyer terms. If you believe you were charged in error, contact us within 14 days of the charge via the contact page and we will review the request with Paddle. Approved refunds are issued to the original payment method.
• One-time purchases (such as SMS top-up packs) are non-refundable once credits have been used; unused credits never expire.

6. Acceptable use

You agree not to:

• Use the Service to post, solicit, or respond to fake or misleading reviews.
• Abuse the AI features, including attempts to generate unlawful, defamatory, harassing, or deceptive content.
• Connect Google Business Profiles you are not authorized to manage.
• Interfere with the Service, probe for vulnerabilities, or exceed reasonable usage limits.
• Violate Google's or any third party's terms of service.

7. Your responsibilities

You are responsible for the replies published to your Google Business Profile through the Service. Review each AI-generated draft before approving it. If you enable auto-pilot, you accept that drafts will be published without individual review, and you remain responsible for their content.

8. AI-generated content disclaimer

Replies drafted by the Service are generated by artificial intelligence. While we design the system to produce professional, on-brand responses, we do not guarantee the accuracy, appropriateness, or completeness of any generated text. AI output may occasionally contain errors or misjudge context. Always review drafts before publishing where possible.

9. Limitation of liability

To the maximum extent permitted by law, LocalPulseHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or reputational harm arising from published replies, service interruptions, or third-party platform changes (including Google Business Profile API availability). Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Termination

You may close your account at any time from the settings page. We may suspend or terminate accounts that breach these Terms, with notice where reasonably possible. Upon termination, your right to use the Service ends and your data is handled as described in our Privacy Policy.

11. Governing law

These Terms are governed by the laws of Kosovo, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the courts of Ferizaj, Kosovo, unless mandatory consumer protection laws provide otherwise.
